Current Status

In September 2017, the Ohio Board of Pharmacy must complete the final rules and regulations for marijuana dispensaries and develop the process for registering patients in the program. The Ohio State Medical Board must decide how Ohio physicians can obtain a certificate to recommend medical marijuana and the Department of Commerce must finish rules and regulations for marijuana processors and testing labs.

Cannabis Grow Limit:
Home cultivation is not permitted.

Cannabis Possession Limit:
Not yet specified. Patients will be allowed to purchase oils, edibles, tinctures, topicals and flower, although the smoking/combustion of cannabis is not permitted.


In June 2017, the Department of Commerce adopted final regulations and began accepting applications for cultivation businesses. They issued up to twelve (12) Level I and twelve (12) Level II cultivator provisional licenses until September 9, 2018. See the following sections for more details.

The acceptance periods for cultivator license applications will be:

    • Level II Cultivator Applications (up to 3,000 square feet): June 5-16
    • Level I Cultivator Applications (up to 25,000 square feet): June 19-30

Ohio State Quarter
Ohio was the 25th state to legalize medical marijuana on June 8, 2016.

Important Cannabis Laws

HB 523 (2016) : will allow patients in Ohio to obtain legal protections to be to possess and use medical cannabis. The law contains 23 qualifying conditions and the state can add more conditions through rulemaking.
